Terms and Conditions
1. ORGANIZER OF THE GIVEAWAY
The organizer of the giveaway is MHP Management- und IT-Beratung GmbH, Königsallee 49, 71638 Ludwigsburg, Germany (“MHP”).
This giveaway is in no way connected to Instagram and is neither sponsored, supported, nor organized by Instagram. The sole contact and responsible party is MHP. Each participant releases Instagram from any claims arising out of or in connection with participation in this giveaway.
2. ELIGIBILITY TO PARTICIPATE
Participation is open to any natural person who has reached the age of 18. Prizes will not be awarded to minors. MHP reserves the right to request proof of age and identity; participation by minors will result in disqualification.
Employees of MHP who are or were involved in the organization and/or execution of the giveaway are excluded from participation.
Participants are responsible for ensuring that all data submitted for the purpose of conducting the giveaway is complete and accurate. Only one entry per person per giveaway is permitted.
The use of automated participation systems (bots, scripts), the creation of fake or disposable accounts, as well as the tagging of obviously artificial or inactive accounts is prohibited. MHP reserves the right to delete such comments and to disqualify the respective participants.
3. REQUIREMENTS FOR PARTICIPATION
Participation in the giveaway requires:
(i) Liking the giveaway post, and
(ii) Following the Instagram account mhp_careers at the latest at the time of submitting the comment and until the winner is selected.
Comments must not contain any unlawful, offensive, or otherwise inappropriate content. mhp_careers reserves the right to delete such comments and to exclude the respective participant from the giveaway. The follow status may be verified prior to the prize draw.
In addition to these terms and conditions, the participation requirements and data protection notices communicated via Instagram or via the participation form by text and/or image shall apply.
All participation requirements, including follow status and proper tagging/commenting, must be fulfilled at the time of winner selection; subsequent changes will not be taken into account.
4. PARTICIPATION PERIOD
The giveaway will take place from 2026-02-24 until 2026-03-08.
5. EXCLUSION FROM THE GIVEAWAY
MHP reserves the right to exclude participants from the giveaway in the event of culpable violations of these terms and conditions and to revoke or reclaim prizes.
In cases of suspected manipulation based on objective indications (e.g. bots, fake accounts, mass tagging of artificial accounts), MHP may disqualify participants until the matter has been clarified. Affected participants will be given the opportunity to submit a statement.
6. EXECUTION OF THE GIVEAWAY
The winners will be randomly selected from all valid and eligible participants by an external service provider using a random generator. The random generator used by the external service provider ensures a fair and non-manipulable selection; details are available upon request.
The winner will be notified via Instagram direct message with further instructions on prize fulfillment.
7. PRIZE
Three selected participants will each receive one MHP Starter Box. Each participant may win only once.
Exchange, transfer, or cash payment of the prize is excluded.
8. FORFEITURE OF THE PRIZE
The claim to the prize shall lapse if the winner does not respond to the prize notification via Instagram direct message in accordance with the instructions provided within fourteen (14) days of receipt.
In such cases, a new winner will be selected by random draw.
9. LIABILITY
MHP shall be liable only for damages caused by MHP or its vicarious agents intentionally or with gross negligence, or as a result of the negligent breach of a material contractual obligation.
Material contractual obligations are obligations whose fulfillment is essential for achieving the purpose of the giveaway and on whose compliance a participant may regularly rely. In the event of a simple negligent breach of such an obligation, liability shall be limited to the foreseeable damage typical for the contract.
These limitations of liability do not apply to damages resulting from injury to life, body, or health, or to liability under the German Product Liability Act.
The above liability limitations apply in particular to damages caused by errors, delays, or interruptions in transmission, technical malfunctions, issues with technical systems or the giveaway website, incorrect content, loss or deletion of data, viruses, or other causes.
10. EARLY TERMINATION / ADJUSTMENTS
MHP reserves the right to adjust, interrupt, or terminate the giveaway prematurely for good cause if proper execution cannot be ensured for technical, legal, or factual reasons (e.g. system errors, changes to platform policies, official measures, force majeure).
Any changes shall be made only to the extent necessary and without unreasonable disadvantage to participants. Already accrued claims shall remain unaffected insofar as performance does not become impossible.
MHP will inform participants of any adjustments or termination promptly via the giveaway post.
11. MISCELLANEOUS
Legal recourse to review the winner selection is excluded. Statutory claims, in particular liability claims and data protection rights of participants, remain unaffected.
German law shall apply. Mandatory consumer protection provisions of the participant’s habitual residence remain unaffected.

This giveaway and these terms and conditions are governed exclusively by the laws of the Federal Republic of Germany.
Should individual provisions of these terms and conditions be or become invalid in whole or in part, the remaining provisions shall remain valid. The invalid provision shall be replaced by a provision that most closely reflects the economic purpose of the invalid provision.

2. SUBJECT MATTER OF DATA PROTECTION
The subject matter of data protection is personal data. This includes all information relating to an identified or identifiable natural person (the “data subject”).
For the purposes listed under section 3, we process the following personal data:
Instagram profile name. In the event of a win, we additionally process your first and last name as well as your postal address for the purpose of sending the prize.
If you have also won a CV screening, the following additional data will be processed: professional qualifications, educational background, interests, and any further information contained in your CV.
3. PURPOSE AND LEGAL BASIS, RECIPIENTS
We process your personal data for the purpose of conducting the giveaway.
The processing is necessary for the performance of a contract or for pre-contractual measures pursuant to Art. 6(1)(b) GDPR, namely the applicable participation conditions of the giveaway.
As part of the Instagram Giveaway January 2026, MHP employees will have access to your personal data only insofar as this is necessary for conducting the giveaway.
In some cases, we engage external service providers. These providers are carefully selected, regularly monitored, and contractually obliged to maintain confidentiality and comply with statutory requirements. Service providers may also include companies within the MHP Group.

4. TRANSFER TO THIRD COUNTRIES
If a recipient is located outside the European Economic Area (EEA), we ensure prior to the transfer that an adequate level of data protection is guaranteed by appropriate safeguards pursuant to Art. 44 et seq. GDPR or that your consent has been obtained.
5. STORAGE PERIOD AND DELETION
We store your personal data only for as long as necessary to fulfill the stated purposes, unless another legal basis applies.
Beyond this period, data will only be stored to the extent required by statutory obligations under EU or Member State law.
Taking into account the purpose of processing, personal data will be deleted no later than two months after completion of the giveaway.
6. AUTOMATED DECISION-MAKING
We do not carry out any automated decision-making or profiling that produces legal effects concerning you or similarly significantly affects you.
7. RIGHTS OF DATA SUBJECTS
You may exercise your rights to access, rectification, objection, and erasure at any time by contacting us via email at info(at)mhp.com or in writing at the address above.
If deletion is not possible due to statutory retention obligations, processing will be restricted. You may exercise your right to data portability insofar as the technical requirements are met by both us and the recipient.
8. RIGHT TO LODGE A COMPLAINT
You have the right to lodge a complaint with a competent data protection supervisory authority if you believe that the processing of your personal data violates applicable law.
